THE FINAL SCOPE OF SERVICES, SLAs (SERVICE LEVEL AGREEMENTS), PRICING, AND LIABILITY CAPS WILL BE EXCLUSIVELY DETERMINED BY THE INDIVIDUAL SERVICE AGREEMENT SIGNED BETWEEN THE CLIENT AND BASTIONID GLOBAL. IN THE EVENT OF A CONFLICT BETWEEN THIS WEBSITE AND THE SIGNED CONTRACT, THE SIGNED CONTRACT SHALL PREVAIL.
BastionID Global provides digital risk management and content monitoring services. The Client acknowledges that the internet operates on decentralized infrastructure often outside of any single jurisdiction's control. Therefore, BastionID Global operates on a "Best Efforts" basis (Obligation of Means), not an "Obligation of Result." We guarantee the execution of our protocols (scanning, legal noticing, de-indexing requests), but we cannot and do not guarantee the 100% removal of all unauthorized content from the internet, particularly from "bulletproof" hosting environments or sovereign-state intranets (e.g., Runet, Dark Web nodes).
The Client warrants that they are the legal copyright holder (or authorized licensee) of the assets submitted for protection. BastionID Global acts strictly as an agent on behalf of the Client. The Client agrees to indemnify, defend, and hold harmless BastionID Global against any third-party claims, damages, or legal fees arising from wrongful takedown notices issued based on false or inaccurate information provided by the Client.
BastionID Global reserves the absolute right to unilaterally terminate services and revoke cryptographic signatures if the Client is found to be using our infrastructure for malicious purposes, including but not limited to: suppression of legitimate journalism, political censorship, or the protection of illegal content (CSAM). Such termination will be immediate and non-refundable.
To the maximum extent permitted by applicable law, BastionID Global shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or reputation, arising out of the failure to remove content. Our total cumulative liability shall not exceed the total fees paid by the Client in the three (3) months preceding the claim.
These Terms shall be governed by the laws of [Jurisdiction - e.g., Switzerland / UK / Delaware], without regard to its conflict of law provisions. Any dispute arising under these terms that cannot be resolved amicably shall be settled by binding arbitration.
